1 Whose data do we process and in what way?

 

1.1 Members, their employees and administrators

In connection with our member support and administration as well as the representation of interests and information of our members, we process some personal data of you as a member or as an employee or organ administrator (in particular as a managing director, executive board or supervisory board) of one of our members.

How we process your personal data is described in this section 1.1. In addition, sections 2 and 3 below provide you with information on international data transfers and your rights in connection with the processing of your personal data.

 

1.1.1 Categories of processed data and purposes of data processing

We will process your data referred to in Annex 1 ("Your Data") for the following purposes:

  • Maintaining a membership directory;
  • Promoting the economic, social and humanitarian affairs of members, strengthening the community spirit and the image of the industry;
  • Ensuring equal opportunities for members in competition, in particular the prevention of unauthorised trade;
  • Promotion of cooperation and joint activities, in particular the establishment of commercial and industrial cooperatives, as well as the development of market and future-oriented sector concepts;
  • Participation in statistical surveys and recordings;
  • Advice and information for our members;
  • Support of authorities and members by providing information
  • Promotion of public and private education in the interest of the members, the promotion of education and training of members and their staff and the promotion of vocational training;
  • Organisation of information events (including invitations, keeping attendance lists and minutes);
  • Provision of information through our newsletter and publications;
  • Advertising and public relations;
  • Inclusion in a business partner database
  • Other activities in connection with membership administration and the representation of interests within the meaning of the WKG and regulations issued for this purpose;
  • Tasks related to the calculation and collection of membership fees according to the statutes of the working group;
  • holding elections in accordance with the statutes of the working group
  • Fulfilment of other legal obligations, especially according to the WKG.

We collect this data within the framework of your membership or in connection with the provision of services by one of our members either by making this data available to us yourself (in particular through communication via e-mail or other means of communication) or by collecting it, for example in the course of consultation meetings, the handling of events, etc. In addition, we obtain the trade data from public registers and sources.

In cases where we ask you to provide your data, this is always voluntary. However, various processes of member administration, representation of interests and information and event management as well as internal and external communication in these matters will be delayed or even impossible if you do not provide your personal data. Should the provision of your data be legally obligatory in some cases, we will inform you separately.

 

1.1.2 Legal basis of the processing

We process your data on the following basis:

  • Necessity to comply with legal obligations to which we are subject, in particular under the WKG, in accordance with Art6 para. 1 lit. c of the Basic Data Protection Regulation ("DSGVO");
  • our predominantly legitimate interest under Art. 6 para. 1 lit f DSGVO, which consists in the efficient organisation of our membership administration and our information and event management as well as internal and external communication in these matters;
  • in individual cases: Your consent to the processing of your personal data (Art 6 para. 1 lit a or Art 9 para. 2 lit a DSGVO).

 

1.1.3 Transmission of your personal data

Insofar as this is necessary for the above-mentioned purposes, we will transfer your data to the following recipients:

  • Organisations of the commercial economy;
  • Members of the Chamber of Commerce;
  • courts and administrative authorities;
  • Public law corporations in the performance of their duties (e.g. social insurance agencies, interest groups, municipalities);
  • Members of legal advisory and supporting professions (e.g. lawyers, notaries, accountants);
  • Money and credit institutions for the processing of payment transactions;
  • Associations and federations for the protection of economic interests and order (e.g. protection association against unfair competition);
  • Labour Market Service (AMS) for the administration of support measures;
  • all those interested in member data, with your consent, unless the data has already been published in a permissible manner or the transmission serves the promotion of economic development;
  • legally established advisory councils, authorities and associations to which members are delegated
  • Contractual partners who are used to provide services;
  • WKO Inhouse GmbH;
  • external IT service providers.

 

1.1.4 Storage duration

Your data is generally stored by us for as long as statutory or contractual storage obligations exist or the storage is necessary for the fulfilment of our statutory duties, until the termination of contractual obligations due to public subsidies that we receive and beyond that, as long as guarantee, warranty or limitation periods have not yet expired.

 

1.2 Officials and employees of commercial organisations

In order to carry out our tasks of functionary administration and the representation of the interests of our members, we will process some of your personal data in connection with your activity as a functionary or employee of an organization of commercial economy. If you are in an employment relationship with us, an additional data protection declaration applies to you.

How we process your personal data is described in this section 1.2. In addition, sections 2 and 3 below provide you with information on international data transfers and your rights in connection with the processing of your personal data.

 

1.2.1 Categories of processed data and purposes of data processing

We will process your data listed in Annex 2 ("Your Data") for the following purposes:

  • Functional administration;
  • Representation of interests, support and advice for our members and other tasks within the meaning of the Economic Chamber Act 1998 ("WKG");
  • Holding of the elections to the Economic Chamber;
  • organising and conducting meetings, including the preparation of invitations, minutes of meetings and attendance lists
  • Communication with you;
  • Event management and
  • Distribution of newsletters and publications.

We collect your data within the scope of your activity as a functionary or employee of a commercial organisation, either by making this data available to us yourself (in particular through communication via e-mail or other means of communication) or by collecting it ourselves, for example in the course of meetings or the handling of events. In addition, we obtain the business data from public registers and sources.

In cases where we ask you to provide your data, this is always voluntary. However, various processes of functionary administration, representation of interests and information and event management, as well as internal and external communication in these matters will be delayed or even impossible if you do not provide your data. Should the provision of your data be legally required in some cases, we will inform you separately.

 

1.2.2 Legal basis of the processing

We process your data on the following basis:

  • Necessity for the fulfilment of legal obligations to which we are subject, in particular under the WKG, in accordance with Art. 6 para. 1 lit. c of the Basic Data Protection Regulation ("DSGVO") and,
  • our predominantly legitimate interest pursuant to Art. 6 para. 1 lit f DSGVO, which consists in the efficient organisation of our functionary administration, our event management and information services as well as internal and external communication in these matters;
  • in individual cases: Your consent to the processing of your data (Art 6 para. 1 lit a or Art 9 para. 2 lit a DSGVO).

 

1.2.3 Transmission of your personal data

Insofar as this is necessary for the above-mentioned purposes, we will transfer your data to the following recipients:

  • Organisations of the commercial economy;
  • Members of the Chamber of Commerce;
  • courts and administrative authorities;

1.3 Founders, interested parties and journalists

If you are in the process of setting up a business ("Founder"), are active in the creative industries or, apart from setting up or managing a business, are interested in our organisation or our information and service offerings ("Interested Party"), we will process some of your personal data as described here. Even if you are a journalist, we will process some of your personal data.

In this section 1.3 we inform you about how we process your data. In addition, sections 2 and 3 below provide you with information on international data transfers and your rights in connection with the processing of your personal data.

 

1.3.1 Categories of processed data and purposes of data processing

We will process your data referred to in Annex 3 ("Your Data") for the following purposes:

  • Information and advice in all matters concerning the creative industries;
  • Information on economic policy issues and our activities;
  • organising and holding information and training events (including sending out invitations and keeping attendance lists and minutes)
  • Provision of information through our newsletter and publications;
  • Other activities in connection with the administration of founders and interested parties and our event management;
  • Organisation and holding of press conferences and press contacts;
  • Public relations.

Your data is either provided to us directly by you (in particular through communication via e-mail or other means of communication) or we collect this data ourselves, for example in the course of consultation meetings or the handling of events.

In cases where we ask you to provide your data, this is always voluntary. However, various processes of founder administration, representation of interests, information and event management as well as internal and external communication in these matters will be delayed or even impossible if you do not provide your data. Should the provision of your data be legally obligatory in some cases, we will point this out to you separately.

 

1.3.2 Legal basis of the processing

We process your data on the following basis:

  • Necessity to comply with legal obligations to which we are subject, in particular under the Economic Chamber Act 1998 ("WKG"), in accordance with Art. 6 (1) lit c of the Basic Data Protection Regulation ("DSGVO");
  • our predominantly legitimate interest under Art. 6 para. 1 lit f DSGVO, which consists in the efficient management of our interested parties, the organisation of events and internal and external communication, including public relations;
  • in individual cases: Your consent to the processing of your data (Art 6 para. 1 lit a or Art 9 para. 2 lit a DSGVO).

 

1.3.3 Transmission of your personal data

Insofar as this is necessary for the above-mentioned purposes, we will transfer your data to the following recipients:

  • Organisations of the commercial economy;
  • Chamber of Commerce members and founders;
  • Other interested parties (including research, business and cooperation associations);
  • courts and administrative authorities;
  • bodies under public law in execution of their tasks;
  • Members of legal advisory and supporting professions (e.g. lawyers, notaries, accountants);
  • Assignees, factoring companies, collection agencies, insurance companies, credit agencies, credit protection associations in their function as creditor representatives
  • Money and credit institutions;
  • Contractual partners who are used to provide services;
  • all those interested in founder data, with your consent as founder, unless the data has already been published in a permissible manner or the transfer serves the promotion of economic development;
  • Labour Market Service (AMS) for the administration of support measures;
  • Cooperation partner of events and educational offers;
  • WKO Inhouse GmbH and
  • external IT service providers.

 

1.3.4 Storage duration

Your data will only be stored by us until the end of the information or support relationship or, in addition, as long as this is necessary to fulfil our legal obligations, in particular under the WKG, or until the end of relevant guarantee, warranty, statute of limitations or other legal storage periods, until the end of contractual obligations due to public subsidies which we receive or any legal disputes in which the data is required as evidence.

 

1.4 Service providers and recipients, their employees and administrators

Within the scope of our activities, we cooperate with companies and persons who provide us with various services (this includes services as well as the supply of goods or sponsoring; "service providers"). On the other hand, within the scope of our activities we also act as service providers ourselves and therefore provide services to natural or legal persons ("service recipients"). This notice concerns you as the recipient or provider of services and as their employees or administrators.

In this section 1.4 we inform you about how we process your personal data. In addition, sections 2 and 3 below provide you with information on international data transfers and your rights in connection with the processing of your personal data.

 

1.4.1 Categories of processed data and purposes of data processing

We will process your data listed in Annex 4 ("Your Data") for the following purposes:

  • Performing our tasks in the sense of the Economic Chamber Act 1998 ("WKG"), in particular representing the interests and advising our members;
  • Organisation and holding of information and training events;
  • Provision of information through our newsletter and publications;
  • other activities in connection with the administration of members, founders and interested parties as well as our event management and public relations;
  • Provision of working materials and infrastructure to ensure efficient internal workflows.

Your data is either provided to us directly by you (in particular through communication via e-mail or other means of communication) or we collect your data ourselves, for example in the course of processing events or services which we provide to you.

In cases where we ask you to provide your data, this is always voluntary. However, if you do not provide us with your data, the processing of the service could be delayed or in some cases impossible. Should the provision of your data be legally binding in some cases, we will inform you separately.

 

1.4.2 Legal basis of the processing

We process your personal data on the following basis:

  • Necessity to comply with legal obligations to which we are subject, in particular under the Economic Chamber Act 1998 ("WKG"), in accordance with Art. 6 (1) lit c of the Basic Data Protection Regulation ("DSGVO");
  • our predominantly legitimate interest under Art. 6 para. 1 lit f DSGVO, which consists in making our administrative, advisory and support activities efficient;
  • in individual cases: Your consent to the processing of your data (Art 6 para. 1 lit a or Art 9 para. 2 lit a DSGVO).

1.4.3 Transmission of your personal data

To theextent necessary for the above-mentioned purposes, we will transfer your personal data to the following recipients:

  • Money and credit institutions;
  • Contractual partners who are used to provide services;
  • Banks to handle payment transactions;
  • Legal representative in business cases;
  • chartered accountants for auditing purposes;
  • Courts and authorities;
  • Debt collection companies for debt recovery (abroad therefore only if the debt has to be recovered abroad);
  • Assignees, factoring companies, insurance companies, credit information agencies, creditor protection associations in their function as creditor representatives
  • Contractual partners who participate or should participate in the delivery or service;
  • Insurances on the occasion of the conclusion of an insurance contract for the benefit or the occurrence of the insured event (e.g. liability insurance);
  • Federal Institute "Statistics Austria" for the production of legally required (official) statistics;
  • WKO Inhouse GmbH and
  • external IT service providers.

 

1.4.4 Storage duration

Your data will generally be stored by us until the end of the business relationship or beyond this, as long as this is necessary to fulfil our legal obligations, in particular under the WKG, or until the end of any relevant guarantee, warranty, statute of limitations or other legal retention periods, until the end of any contractual obligations due to public subsidies which we receive or any legal disputes in which the data is required as evidence.

 

1.5 Policy makers and stakeholders

In the course of fulfilling our duties under the Economic Chamber Act 1998 ("WKG"), in particular with regard to the representation of interests and in connection with events organised by us, we process personal data about you as political decision-makers or representatives of interests of employees (e.g. officials of the Chamber of Labour or trade unionists), consumers or companies.

In this section 1.5 we inform you about how we process your personal data. In addition, sections 2 and 3 below provide you with information on international data transfers and your rights in connection with the processing of your personal data.

 

1.5.1 Categories of processed data and purposes of data processing

We will process your data referred to in Annex 5 ("Your Data") for the following purposes:

  • Performance of our tasks in the sense of the WKG, in particular the representation of interests
  • Invitation to and handling of events;
  • Sending our newsletter, information and publications.

Your data will either be made available to us directly by you (in particular through communication via e-mail or other means of communication) or we will collect your data ourselves, for example in the course of activities in connection with the handling of events.

In cases where we ask you to provide your data, this is always voluntary. However, various processes, such as the sending of our newsletter, could be delayed or even become impossible if you do not provide us with it. Should the provision of your data be legally obligatory in some cases, we will inform you separately.

 

1.5.2 Legal basis of the processing

We process your data on the following basis:

  • Necessity for the fulfilment of legal obligations to which we are subject, in particular under the WKG, this in accordance with Article 6 paragraph 1 lit c of the Basic Data Protection Regulation;
  • our overriding legitimate interest under Art. 6 para. 1 lit f DSGVO, which consists in making our information activities efficient;
  • in individual cases: Your consent to the processing of your data (Art 6 para. 1 lit a or Art 9 para. 2 lit a DSGVO).

 

1.5.3 Transmission of your personal data

Insofar as this is necessary for the above-mentioned purposes, we will transfer your data to the following recipients:

  • Organisations of the commercial economy;
  • Other interested parties (including research, business and cooperation associations);
  • WKO Inhouse GmbH and
  • external IT service providers.

 

1.5.4 Storage duration

Your data will in any case be stored by us for the duration of your professional activity, or beyond this for as long as this is necessary for the fulfilment of our legal obligations, in particular in accordance with the WKG, or until the end of relevant legal storage periods or until the end of contractual obligations due to public subsidies which we receive or any legal disputes in which the data is required as evidence.

 

1.6 Users of our website

If you visit a website operated by us, we will process some of your personal data in connection with this visit.

In this section 1.6 we inform you about how we process your personal data. In addition, sections 2 and 3 below provide you with information on international data transfers and your rights in connection with the processing of your personal data.

 

1.6.1 Categories of processed data and purposes of data processing

In the course of your visit to this website we will automatically collect the following personal data about you:

  • The date and time a page on our website is accessed;
  • Your IP address;
  • Name and version of your web browser;
  • the web page (URL) that you visited before accessing this website
  • certain cookies (see section 6.5 below).

We will also ask you to enter personal data on our website, such as your name, the name of your company, your address and your e-mail address, in order to provide you with our newsletter, so that you can order our creative industries books and creative industries reports and register for our events. For former participants of C hoch 3, we provide a user account that you can maintain yourself and with which your company is visible on the Google Map on our website.

There is no obligation to actually provide the data that we ask you to provide on our website. However, if you fail to do so, you will not be able to use all the functions of the website.

We process your data for the following purposes:

  • to provide you with this website, including related services, and to further improve and develop this website;
  • to be able to create usage statistics;
  • to be able to recognize, prevent and investigate attacks on our website.

1.6.2 Legal basis of the processing

We process your personal data on the basis:

  • the need to fulfil legal obligations to which we are subject, in particular under the Economic Chamber Act 1998 ("WKG"), in accordance with Article 6 (1) lit c of the Basic Data Protection Regulation ("DSGVO"), and
  • our overriding legitimate interest under Art. 6 Para. 1 lit f DSGVO, which consists in making our website user-friendly and protecting our website from attacks.

 

1.6.3 Transmission of your personal data

To the extent necessary for the above-mentioned purposes, we will transfer your personal data to the following recipients:

  • WKO Inhouse GmbH;
  • external IT service providers, including Google Analytics (see Section 6.6 below).

 

1.6.4 Storage duration

We will store your data for a period of three months. Longer storage will only take place to the extent necessary to investigate attacks on our website and only until the end of relevant limitation periods, statutory retention periods or any legal disputes in which the data is required as evidence. In addition, we store the data that we collect to provide your user account (Creative Industries Coaching C hoch 3) for as long as your account exists.

 

1.6.5 Cookies

So-called cookies are used on our website. A cookie is a small file that can be stored on your computer when you visit a website. Cookies are generally used to provide users with additional functions on a website. 2 International data transmissions

Some of the recipients mentioned above may be located outside Austria or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection. For this purpose, we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC), for example. The agreements concluded are available on request at kreativwirtschaft@wko.at.

 

3 Your rights in connection with personal data

Under applicable law, you are entitled (subject to applicable law), among other things, to (i) check whether and which personal data we hold about you and to receive copies of such data, (ii) request the correction, completion or deletion of any personal data that is incorrect or not processed in accordance with the law, (iii) request us to restrict the processing of your personal data, (iv) object, under certain circumstances, to the processing of your personal data or revoke any prior consent given for the processing, such revocation not affecting the lawfulness of the processing until revoked (v) require data transferability, (vi) know the identity of third parties to whom your personal data are transferred, and (vii) lodge a complaint with the data protection authority.
